Are you employed by a US firm. My only concern is that if you apply from indian and are out of US for an extended period of time, USCIS may assume that you have abandoned your immigration intent.

Hi,
Background filed H1 extension on Jan 2009 got approved Mar 2009, Got Approved I129 , Got the stamping H1B done in India. Online I129 status was still pending - Ignored that since I got the physical approval notice.
Feb 2009 changed Employer and started working on EAD, on June 3 the online status for I129 has been updated to Denied.
I am checking with my former employer to see if they withdrew my H1 (They typically don't withdraw H1).
I have not filed AC21 with my new employer.
Questions :
1. I have heard of online status still being in pending status even though its been approved. Have anyone heard of its getting denied ?. What are the implications ?.
2. There was a soft touch on my 485 on April 28. and i have not filed for AC21. Should i file AC21 ?

I am using Advance parole in december to visit India. I have applied my canada PR in 2008, but I don't have stamp of PR in my passport.
Is there are any problems using AP for India visit.

Guys
Just want to know my options here and here is my scenario:
I am on H1-B and my 6 years of H1B is going to complete on March so I have almost 1 more year to complete my 6 years of h1-B
Right now, I have my LC and I-140 approved from my present employer.
Now, I am thinking about moving onto a new job where the new employer is ready to start my GC immediately I take the new job.
My question is:
If I take the new job, would I get my new H-1B for 3 years since my I-140 with old employer/current employer is already approved ?
I don't have the copy of my I-140 but I think I can get it.

I just spoke with Xiyun Yang from Washington Post and conveyed thanks for covering a detailed article. She expressed that there is attention being drawn by many quarters including political for "Skilled LEGAL Immigrants".
Also we need to emphasize & communicate is the "increased fees" (almost doubled in many cases) for all USCIS services effective end of this month (July 30). Is this the penalty to be legal ?
The rallys and campaigns should emphasize this important detail too. This is huge money and not fair to the amount of service that is being currently provided.

My PERM was filed on July 18, 2007. PERM got approved on July 26, 2007.
I-140/I-485 concurrent will be filed in first week of august 2007.
Which fee will be applied in this case ? New August filing fee or same July filing fee?
USCIS FAQ are confusing for this scenerio. I am sure lot of people are in the same boat. Kindly let me know what is the right filing fee for this scenerio.

The inventory number does not include the EB1 and EB2ROW filings, which are always C and out of queue/approved in less than 6 months. They are not shown in inventory numbers.

I am on 6th year and need to extend my h1b. My lawyer informs me that 45day letter from Backlog center is enough for 7th year extension.
I thought we need to get the screen-shot of pending labor as a proof for 7th year extension.
Does anyone got extension based on 45day letter for the 7th year or beyond....???

my wife is on her OPT and I am on my F1, her employer just filed for her H1b and my H4 I539 same time this week. (non profit university). So my question is do i need to go back to school next month to continue my education? or as long as the I539 is filed, i am under legal status? right now I have moved from Nebraska where we had our education to New york with my wife. if I have to go to school even when the I 539 is pending, can i just go transfer my status from the community college I am studying at in Nebraska to any community college that offers I-20 in New york? how can i report the change of school to USCIS after transfering? thanks!

Hello
My friend is in USA on F1 visa and her wife and daughter denined visa twice with reason that my friend is studying here not working.
Even he is not offering sponsership to her wife and kids. His in laws are sponsering both of them. Now he wants to invite them on his graduation day. Can he get a letter from local senator with F1 visa status ? or is that only for people who pays taxes . ( H1b or l1b ) ?
Please advise.
