I have a question regarding location change with same employer. I have labor approved on EB2 India with PD 01/2005. I am employed with a big health care firm which has various locations in the region. I'd like to move to another location which is 30 miles away from my present site. I140 is pending with the same employer. I have also posed this question to my lawyer but appreciate greatly if anyone knows answer to this. Will this affect my GC?

please advise what steps should be taken if I recieved the NL letter from KCC that I am selected for 2011 DV lottery.
I am in AOS in EB3 category, my H1B already expired, working on EAD.
My case number from DV lottery is very high (29***).
What should I choose - CP or AOS???
Should I fill and return back to KCC both forms - DSP-122 and DS-230 forms??? :confused:

Some big compromises in the House version that dropped this morning. First, there will be $2525 in filing fees, $525 of which is due at the outset and $2000 of which is paid five years in to the ten year conditional non-immigrant period. That should presumably answer critics who complain that DREAM will add to the deficity. Also, conditional status is granted in two five year terms and the college education/military service requirements must be met in the first five year term in order to get the extension approved. Can i travel on my H1B and Advance parole (EAD) and maintain the same H1B when i come back to the US? I've heard rumors that I will be forced to use the EAD on arriving at the airport. Hence I will lose my H1B (They have been serving as backups to each other)
Here are some additional details:
- Currently working for a company as an employee on my H1B
- H1b doesn't have valid stamping (should i go that route and get that??)
- My 485 Pending. Priority date is Aug 2005 on EB3
- Indian Citizen but born in Africa (EB3 is Rest of the World)
- Have had my EAD for the past two years (havent used it).
- i switched over companies last year and ported the greencard process - AC21
- I have an expired Advance Parole i filed over an 1 1/2 years ago (never used it) and was planning on re-applying for it
- I've lived in the US for the past 15 years and have at no point been illegal.
- Planning to travel to Europe in June.

Does anyone,please could help me with the following query?
If my I-140 is not approved yet, is Uscis touching my I-485 application....in other words is I-485 being processed (not approved, only processed)even if I-140 is not approved?( I applied concurrently in August 2007, and my priority date is current, Eb3 ROW).

I am currently working on H1B. My wife is currently in India with approved I797 for H1B (starting Oct 07). We are debating whether to get H1 or H4 stamped on passport. (H4 is totally our decision and for H1 we need to depend on her company's schedule).
- Can she come to the US on H4 (lets say next month) and if and when she finds a job (lets say next year), can she switch to H1? Is there a time limit before H1 will become invalid?
- If she comes to the US on H4, are there any issues changing status to H1?
- Are there issues when she goes to India again to get H1 stamped?
- Is there a difference between the I797 approval notice if a person is out of US vs. in US? (I have read something about I-94. I thought I-94 is always attached to 797 approval notice).

If I have I140 approved and I have 3 year extention after my 6 years on H1B. Can I get H1B transferred to a new employer and then start my Labour all over again.

I came to US last December to visit my family by a tourist visa. during the time that I was here I got a letter that showed I won DV lottery. so I hired a lawyer and he told me he will be able to apply for me from here. so he prepared our file before our visa expiration date and sent our file. but we got rejection notice and he said this is because of sending it early. he did the same 3 times but each time we got the same rejection notice. now he says that we are out of status and our case is dismissed!! As i checked USCIS office, we were not able to send it before November according to our case number. now I want to know what should I do? is it really over?

I got my H1 approved in Oct 2004 and it was from Oct 2004 - Oct 2007. I used only 6 months of H1 and later went on TN (work visa for Canadian citizens) and remained in US working on TN for 4 years. I was in US all these years. Now even the earlier H1 approval duration is over, Can I apply for H1 with another employer using the old 2004 H1 quota cap or it has to be under new 2009 cap? I received the excellent news today that the Memphis Youth Symphony Program has landed Bulgarian-born Stilian Kirov as it's new Music Director and Conductor. And since one of my children performs with the MSYP, the news is even better. Kirov is a graduate of the Julliard School of Music and has conducted major orchestras across Europe and the United States. Stilian is also an accomplished pianist. In 2001, he was awarded a gold medal in Paris' Claude Kahn International Piano Competition. We look forward to Maestro Kirov coming down Memphis way.

Based on the posts in this forum,during POE the I-94 will say AOS pending status if you enter using AP..So i dont think it matters with AP validity date.

I am currently on STEM OPT and have lost my job. I have an offer from Company A but they are not willing to enroll into the eVerify system. To bypass this, they suggested that I take up employment with a consulting firm B (who is enrolled in eVerify) and then work on company A's project as a contractor through firm B. Would this be legally OK? I heard that even though I would be on company B's payroll, company A should still be registered with eVerify.
Can someone please advice on what is the legal requirement??
