I saw soft LUDs on all our applications at NSC (pending 485s, 131s and approved 765s) on 12/12 and 12/15. This should mean some sort of system update on NSC, is it ? or should I look forward to good/bad news :confused: ? My PD is nowhere close to the current cut off date for EB2-I.

One of the comments on my post earlier today about the killed Border Patrol agent seemed pretty harsh - accusing most BP agents of being restrictionists with bad motives. I still think that's harsh and most Border Patrol agents are honestly out to do the necessary job of protecting our country's borders. What is the new fee structure from Aug.
Is there any use in waiting till next bulletin?

I am initiating this poll to find out priority date segments, as I could not found a poll for priority dates tracking.
I have divided priority dates in eights segments. From the eight segments, I have created three specific segments from Jan 2004 to June 2004, June 2004 to Dec 2004 and Jan 2005 to March 2005. The people in these segments are most likely to get their GC (If USCIS process in FIFO manner) as soon as the backlog with priority dates before 2003 is cleared. The first three months of 2005, Jan to March, when lots of people applied, just before a new PERM labor certification process was introduce. This will help separate the three months from the rest of the year 2005.
Please join me to track priority dates which is the key date for GC approval.

My cousin from India has a BCOM degree and he is filing for a H1 B visa.
He just heard from his lawyer 2 days ago that his credit evaluation was needed and he had to get experience letters for atleast 3 years of work ex.
He gave it to his lawyer and now they tell him that they will submit his application without the evaluation! They said that once an inquiry comes if it even does then we will submit the evaluation.
Is that ok??? or should he be submitting the evaluation with the application. I am concerned but I guess it too late now.

Hi, Last year, I heard about a new rule that says that H4 time will not be counted against H1 time so basically, if someone is transferring from H4 to H1, the time spent in H4 will be excluded while deciding the duration of H1.
Is this rule true ? I mean, has it become a law now ? Did somebody use this rule to grab the time spent in H4.
Please let me know.

You should be able to work use EAD...your husband can still work on H1. First u need to apply for SSN to work.

My husband is on H1 and i am on H4. We recently got our EADs. What I want to know is, can i start working right away with my EAD while my husband works on H1 or are there any rules like my husband also needs should change his status from H1 to EAD so that I may use my EAD card?

Hi,
I have my labor certiifcation approved and currently filed for I-140.
I-140 is not approved yet.
I have an offer from another employer with very similar job profile.
My 6 yrs of H1 is getting over in 2010 summer.
My prioriy date is Dec/07.
What are my options
1) Can i change a job and keep same priority date(as job profile is very similar)
2) Do I have to start from zero again?If yes,how much time I have to get priority date assigned again(considering my H1 bgets over in 2010 summer?)
I will appreciate your comments

Hi friends,
I completed my Masters degree this May 08 and started working on opt for a company A. Meanwhile another company B filed for my H1 and it got approved. But i would now like to continue working for my current company A.
1. On what status would i be on October 1?
2. Could i continue working for Company A on my OPT even after October 1?

I am on my 8th year of H1(on the 3 year extension). Recently I travelled to India and came back on the Advanced Parole. I am continuing to work on the H1 extension for the same employer inspite of being admitted on "Parolee" or "AOS" status as per my Attorney and several others who quote an INS memo called the Cronin memo.
My question is:
Now if I want to join another company, can I get a new H1B I94 stamp from the H1 transfer without leaving the US ?
Can someone please shed any light on this, anyone with experience of such a conversion from Parolee to H1.

For the past few months, there have been no green cards available for persons in the employment-based third preference category (EB-3) and long backlogs in the EB-2 category for persons born in India and China. So, with few green cards to grant, why has the USCIS been scheduling interviews for persons in these categories? The short answer is that just because the USCIS cannot grant most EB-3 and EB-2 applicants green cards, the agency can take advantage of the lull in applications for adjustment of status to deny persons with pending applications. My details are
- EB3 / Labor filed and approved during July/2007
- I140 & I485 filed concurrently during August/2007
- I140 got approved on Jan/16/2009
- EAD Renewal is made and existing one is valid till Nov/2010
I have only labor number, 140 approval notice with me. where as I do not have labor complete job description.
As of now
- Can I change my employer without any labor job description?
- Does my employer has still rights to revoke I140?
- How can I change job to new employer and protect myself from I140 revoke by existing employer?
- GC filing expenses was completely bared by employer only.
