Hi
I applied for L1 to H1 Conversion, but i am planning to travle to India from July 23 and will be back to US on 13th Aug.
Can I travle outside US after applying for conversion. Need some one to response ASAP
If you travel out of the U.S. while an application for change of status is pending the USCIS will deny the pending change of status application.

I am fron the UK and my PD is July 2007. I140 approved Feb 2009. Does anyone have any Idea of the length of the backlog for E3 visas for the UK.

Hi Gurus,
I wanted to know if I can work for H-1B with my current company which holds my H-1B and work outside with another company on EAD. Is there a chance that I may loose my H-1B status if I work with EAD.

When you start using EAD you will lose H1 status. You can do multiple jobs on ead but not on H1

As Senate Democrats were preparing to go to the mattresses over Iraq voting procedures and as Republicans threatened to stop all activity over a judicial appointment, it's worth recalling what Senate leaders were promising at the outset of the 110th Congress.
On Jan. 4, incoming Senate Majority Leader Harry Reid (D-Nev.) declared on the floor that "last November, the voters sent us a message - Democrats and Republicans. The voters are upset with Congress and the partisan gridlock. The voters want a government that focuses on their needs. The voters want change. Together, we must deliver that change."
Minutes later, Minority Leader Mitch McConnell (R-Ky.) observed that "the challenges ahead will not be met if we do nothing to overcome the partisanship that has come to characterize this body over the past several years. A culture of partisanship over principle represents a grave threat to the Senate's best tradition as a place of constructive cooperation. It undermines the spirit and the purpose of this institution. And we must do something to reverse its course."
Six months on, the Senate has devolved into a nonstop brawl. The House, where leaders made let's-work-together promises of their own, also is a cauldron of partisanship, but at least there the rules permit a majority to rule.
But together, they've been able to pass just three pieces of significant legislation - a hike in the minimum wage, expansion of stem-cell research funding and a supplemental appropriation to fund the Iraq War. Only the first was directly signed into law. The second was vetoed by President Bush. The third was vetoed then passed.
Partisan warfare and inaction on issues from health care to immigration to energy - even lobbying and ethics reform, once the top priority for this Congress - has reduced respect for the legislative branch to its lowest level ever. Respect for the presidency is not much higher.
Who's to blame? Senate Democrats accuse Senate Republicans of "obstructionism" - systematic refusal to grant unanimous consent so that bills can be voted upon. Senate Republicans blame Reid for invoking cloture to stifle full debate and the offering of amendments.
The level of rancor is escalating now because Democrats are frustrated that Republicans are insisting on a 60-vote threshold on Iraq War amendments - as though Democrats in the past have not used the 60-vote requirement when it suited them. Republicans are threatening to create procedural chaos and allow little or no action on the floor if Democrats block a single appellate court nominee.

If it has been more than 90 days for the EAD renewal application and the EAD is about to expire, what can one do? I know they no longer give walk-in EADs. I have tried to contact them but no positive response. Any help would be appreciated.

Is it true that if you are on H4 visa and you are using Ead ...and your I-485 is denied...this invalidates your H4 status and you have to leave U.S?
I know that this situation applies only for H1B holder, not H4, the dependent.
If I'm out of H4 status...what are my options? How can I go back to H4 status?
Please advice....this is vey important for me.

Here is my story
July 2nd - Wife and I applied for 485\EAD\AP
The lawyer sent a single check(I know !!! I know !!!)
Our applications got separated.
Mine came back on Aug 30th and my wifes last week
We have now refiled
This time it has gone for "special handling"-bypassing the mail room
I haven't got the receipt yet
Anyone who had a similar experience or went via special handling for some other reason...
How long does it take to get the receipt nowadays ?
(I couldn't see any receipt update on USCIS- I guess most of the people are past that stage)
Will special-handling speed up my Receipt OR EAD OR AP?

Hi
presently i am working on h1b for a tech company. I also have my ead (obtained as a result of july 07 fiasco).
Can i start a company, incorporate a llc or a class c company on my ead? What would be my options?
i know that if i had solely my h1b, i could start a class c company but not work for it(use a gc or a citizen) to do it
my question is that can i still continue on my status quo--ie use h1 for my employer and use ead to start a company, or i have to give up my h1 status? since my wife is on h4, i have to continue on h1b until she gets her ead.

a) H1 extension(I797) approved but no I94
b) Visa stamp and I-94 expired when I applied ( my mistake)for extension but I-797 was valid. Have EAD and Advance Paroll
c) Wife is on H4 and I cannot add her to greencard process because priority date is not current.
d) I need to maintain H1 for my wife.
e) She returned to India before her H4 expired.
f) I work at a client location via a middle vendor so recently found out it does not conform to H1 employer-employee relationship.
1) Is there any time restriction on when I should get Visa stamping done?
2) Client agreed to give client letter but I am worried that I will be rejected at H1 visa stamping because of employer employee relationship requirement.
3) Is it a better startegy to not go to India, send my wife for H4 stamping and bring her to US or is it safer for me to go for H1 visa stamping?
4) Should I change jobs to a client who will transfer H1 and continue my greencard (possibly apply for EB2) before going to India for H1 stamping?
5) Please suggest best course of action.

Currently am on H1 with GC Sponsoring company. I have also filed my I 485 in July 07.
I have got a contract project interview with a prominent company. But I was told that I have to be on W2. I am not clear what does that mean.
Does it mean that I have to move over to EAD if I get the offer?
Can I still work with the sponsoring company and be on w2 for the contract. I am not sure what is correct way of going with the offer. Can some one help me understand this?

We should not look ungrateful. People will appreciate this community even more if we show gratitude too. The press we got for our non violence movement along the lines of Mahatma Gandhi, speaks of our integrity and our culture.
We have a strong cultural background, with Mahatma Gandhi as our visionary and ideal. We follow his principles and I am sure if he had been here today, he would have had the same drive to thank the government for revoking their decision and restoring faith in the immigrant community?

I also received RFE. It was related to TB chest X-ray. In '07 doctor said, it is not requited but USCIS feels other way.
