Is it true that they really approved 60000 cases in June. I have a couple of friends that filed I-485 in 2005 and there background is clear too but still have not been approved. I don't understand what is going inside the blackbox. I read in forum that only 40,000 application were ready for approval but then why didn't these people application was not approved all thou there file was complete.

Hi,
I am on EB2+PERM. I got LC approved and currently filed for I-140 and 485.
As I understand unless the I-485 is pending for more than 180 days after the approval of I-140, I have to restart the whole process again with the new employer (expect that I can port PD if I want to).
Now are there any chance that if the above scenario happens, and my employer did not revoke I-140 or 485, that I can still receive my GC? Or that will be illegal? Please clarify.

Hi there,
Please correct me if i am wrong.
WH-4 Time line is within a year, means if betrayel/non payment happened with in a year from the date of reporting it will be investigated, and YOU CAN FILE WH-4 FROM OUTSIDE OF US ALSO, if your consultant company sent you back with fake commitments.
But not sure if your h1 still have time, after DOL complain, you can transfer it or not??
Anyone has any idea???

Hello Everyone,
Iam an H4 transferred to H1B. I am on H1B since one year. My pay is less than the one mentioned in LCA, but more than the prevailing wages. My job profile also includes some part of salary as comission, which I would get at the end of the year. This is apart from the salary Iam receiving right now (greater than the prevailing wage and less than LCA). Do I face any problem if I happen to go for H1B visa stamp. Could you also suggest me how to defend myself if I am asked the difference in the salary by visa officer. Thanking you all in advance.

Hello ,
My EB3- 485 is pending from June 07. I am on H-1 and my employer decided not to file 7 th year extension and asking me to use EAD.
If I change employer using EAD (AC21) , can new employer file GC in EB2 (EB3 priority date 2005) ( not H-1 transfer)

On 10/01/09, President Obama signed a continuing resolution to fund continued federal government operations through October 31, 2009. Included in the legislation were provisions to extend the E-Verify, Religious Worker, Conrad 30 and EB-5 programs.
The continuing resolution was attached to the FY10 Legislative Branch Appropriations bill (H.R. 2918), and was passed by the House of Representatives on 9/25/09 and the Senate on 9/30/09.
The E-Verify, Religious Worker, Conrad 30 and EB-5 programs have all been extended for an additional 30 days, though all they may be extended further in the coming weeks once the Senate and House conference the FY10 Homeland Security Appropriations bill (H.R. 2892).

I am on 6th year of H1B. My visa expires in Sep 2009. My mom is likely to appear for B1 by Oct 2009. My 7th H1B extension has been approved, but I have not stamped the visa

Per old instructions everyone was sending to Nebraska, and new instructions published are for 'direct filing'.
Do I follow direct filing rule or Nebraska only rule?
I am finally ready with medicals and photos and will be sending packet tomorrow.

I applied for a green card via a relative application on April 28th of 2001. I am under the 245I law. It has been 10 years since the application and it has been approved. A lawyer told me I have one more year to wait since they are still working on the visas from April of 2001. My question is: What month are they on currently and is there any way I can speed up this process? Is there a website where I can keep track of where the visas are?

Guys, Due to all this mess up with dates I decided to file 485/EAD/AP myself and for my wife on 6/29; so filled up everything, attached copies, photos and what not and FedExed all to USICS on June 30 to hit them on 2nd July.
Now I see that by mistake I have put my SSN on my wife's 765. She has been always on H4, never had SSN.
1. What can be the consequence of this mistake?
2. Should I try to pull it back from USICS and submit again (if it's at all possible)

I am a july 2nd filer , still waiting for EAD for my spouse .I have got mine a week ago,but her case status has no change. When we call 1-800-375-5283 it says there is no information for this case, however we are able to check the case status online, which says received on October 15, and its still pending.
Another issue is they did not honor the received date.
Is there any one in similar situation?
What can we do at this point? Will Infopass appointment or contacting ombudsman help?
