Hello All,
Being on H-1 never allowed you to get promoted unless the employer did all the necessary paperwork with USCIS/DOL. EAD being work authorization not limited to current employer, can EAD mean a little more freedom to waiting-for-GC H-1Bs in terms of being able to get promoted within the organization, get different job titles, etc ?
Also, I have 140 approved and H-1B ext was granted for 3 years (till 2010). Does it make any sense to apply for EAD alongwith 485 ? If EAD gives the career advancement opportunities, can I apply for it but keep using my H-1B to re-enter US till 2010 if needed ?

I want to transfer my H1-b from a consultant company to a non-profilt organization which is offering me a full time job. I haven't resigned my job at consultant company yet. The LCA process is going on with new non-profilt organisation and then they are going to apply for H-1B petition soon. I am worried if the consultant company will cancel my visa as soon as I resign and that would cause issues for the H-1b transfer. Please advice when is it safe time to resign and start my new job.

Hi,
The I-485 case of mine, my wife and son was approved on Aug 5 2010. My case is EB2 and priority date is Jan 2006. When I enquired USCIS 2 weeks back on not receiving the physical cards for us yet, we got a reply mail for all of us that USCIS is waiting for our biometrics. Why is a biometrics needed after I-485 is approved? Me and my wife gave our biometrics last September only.
We are not sure when we will receive our biometrics notice and how long will it take to get our physical cards after that? Please guide me on this.

Just curous - if anyone has experience of filling W8-BEN form. Our bank has sent a letter addressed to my wife requiring her to fill that form.
Does anyone know we have to fill this form?
Aren't we "RESIDENT" fom IRS point of view.

Yes, the AP is valid for one year and for as many visits as you want. Same thing happened with me. You can travel again with the stamped AP.

Yesterday I received email that card production ordered and today it says I have to go through some ADIT processing. Does this mean that they require some additional documents for processing or verification. The exact message is as below...
"On August 6, 2010, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before receiving your card, please call our customer service center at 1-800-375-5283.
During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner. You can use our current processing time to gauge when you can expect to receive a final decision.
"

I read in one of the threads (couldn't locate it now) where USCIS asked for the financials from the new employer in an AC21 case. So just be prepared.

To invoke AC21 after 180 days of pending I485, I140 does not have to be approved. But its risky as your I485 application is based on I140, if things go wrong with underlying I140 then your I485 case will be affected.

Last year, employers submitted so many H-1B petitions, the USCIS had to pick the winners by lottery. This year, seven months after the opening of the filing season that started on April 1st, the H-1B cap has yet to be reached. However, the numbers may not last long. During the first week of April, the USCIS received almost enough H-1B petitions to fill the 20,000 cap for persons with advanced degrees, but only 43,000 petitions against the 65,000 general cap. Hello, My parents on B1 visa just entered the US a few days ago. This is their 2nd visit. I extended their stay beyond the given 6 months when they came last time. My mother got a 6 months term on her I-94 this time which is ok but my dad was granted only 60 days of entry and he said the immigration officer has marked in Black marker pen saying "No Extention" on his I-94 card. The justification they gave was that they were unable to find his previous extension, but if they were unable to find his extension, how could they even permit his entry in the first place since overstaying without extension would be illegal.
My question is with "No extionsion" marked in writing on my father's I-94, could I apply for his extension beyond the granted 60 days?
Please answer this question so that I can take the needed action.

New/amended 140, if the LC states correct job requirements (assuming the mistake was made on 140 application).
New LC if old LC states incorrect job requirements.
I have a Masters Degree in the US and the 5 yr experience required for the EB2 also the position requires it; however my lawyer made a mistake and asked for an EB3.
I already received my I-140 and my I-485 was filed at the same time.
What can I do to change to EB2?
