I am currently in my 6th year of H1-B. I started working for my current company on H1-b work visa in June 2010. As my 6 year visa period expires in June 2011, I need to apply for a H1-b extension (based on I-140 approval) pretty soon. My employer had paid the $1500 ACWIA fee recently i.e. 8 months ago, when they filed for my H1-b the first time. Next month, when they apply for an extension of my H1, do they have to pay the $1500 ACWIA fee again?
In I-129 instructions, it specifies that one of the exemptions for paying the ACWIA fee is "second or subsequent extension...". Would my case be considered a subsequent or second extension?
I would greatly appreciate your response.

Hi,
I am transferring my H1B from Employer A to B.
With Employer A, I had my recent H1B extension approved till Oct 31 2011.
I am going to have the period on this transfer as June 1 2009 - Oct 31 2011. (Which will 6 yrs in total on H1B status for me).
I have question on form I-129, "Requested Action" section.
Out of the following options, which one should I "Check":
1. Extend the stay of the person(s) since they now hold this status.
2. Amend the stay of the person(s) since they now hold this status.
Please let me know.

Yes, as long as the new job is same/similar to job B. The 180 days count is number of calendar days i-485 is pending, not number of days on the job. One may not even be working at all during that 180 days, or even while waiting for i-485 approval however, must have a very good excuse because IOs will be very suspicious. It is not violating any rules though as i-485 is for future employment.

Also I would like to see a comprehensive idea posted from IV and drive our members to upvote the idea so it will be on the top as top rated , most commented idea.
Whether DHS will follow through or not at the least we will be educating more people on our legal immigration woes.

My Husband was a F1 international student and his F1 service had stopped by his school, but his Visa( China) was expires on July, 2009. Couple months ago, he and I gets married and he is ready for file the green card. But his grandfather is very sick now and he have to go back immedately; however, he didn't file anything at this time. If he having a emergry that need to go back on June , what he can do now? Hi. I am a Canadian Citizen that was offered a Management job in US.
I would appreciate any advice in regards the best way to ensure a LONG stay in US. The company wants to start with a TN.
Strategy #1:
To stay under TN and keep it renew it for a long term �. 10-20 years. The risk is that the guys at the border will say no at some point; however I wonder if I can request an appeal since there is no limit per TN rules.
( are there any cases that have stayed that long?)
Strategy #2:
Start with a TN then file an H1b and wait for the Labor of certification to be approved. If I do not hear anything in 1 or 2 years; change to TN to revise the strategy�. in order to avoid consuming the H1b 6 years lead time allowed and try again later.

Yes, as long as you have valid AP, you can re-enter and resume working on a valid EAD.

when does the six month count down for AC21 begin???? Is it after receit date or fedex date..thnx

You need to wait till your I-140 is approved. Otherwise, you will face problem in AC21 stage.
That said, the 180 days count from "receipt" date in your I-797 (receipt for I-485). And its better to have few days more, if not few weeks/months (just to be safe).
