    Hmmmm - but all these top Attorneys are professional - I mean - why would they tell you just the opposite for getting money through h1b transfers - I don't believe it.

    I did seek paid professional councel from Attorneys and thats how I was convinced that h1b is safer.

    Like say - of a h1b extension/transfer is successful - then the h1b is typically delinked from what is happening to 485 or 140. As per my understanding a pending 140 or a pending labor is the basis for h1b extensions and they are not coupled whereas an EAD is coupled with 485 and the denial hits the EAD straight because of its direct association.

    Folks correct me if I am wrong

    Don't get me wrong. There are so many good lawyers. I have talked to few of them who are reputed and didn't even charge me for my first call.     Hi Angel,
    I think I am in a similar situation with you.Me and my kids are also separated from my wife for almost a year now. It was really a big mistake on my part not to join her on her Embassy interview thinking visas were plentiful.BIG MISTAKE. I was at that time not well informed about visa availability.Our PD is Nov 05 and I am from the Philippines. I do feel what you feel. It is an emotional roller coaster ride. Are you derivative beneficiaries of your wife's Sched A petition and what country are you from? If you dont mind me asking.

    'One leg of an IITian is in India, the other in Air India' went a popular wisecrack of the late 1980s and early '90s. No longer. The brain drain from IITs has diminished to a trickle, with only 21 out of 3,980 BTech graduates going abroad in 2006.

    About two decades ago, over 80% IITians hopped on to a plane for foreign shores, the preferred destination being the US. The 'IIT route' was a BTech from IIT, an MS (Masters) from USA and a dollar job. Much has changed since then, and brains that used to be siphoned off by developed nations are now preferring to stay back home.

    In the early 1990s, the outflow of computer science graduates to the US was so high that the World Bank, in a report, had suggested that an exit tax be imposed on IITians and other professionals leaving the country � this, it said, could earn the government over $1 billion (about Rs 4,400 crore) per annum. Today, if the government decided to adopt this, it would earn only crumbs.

    A quick look at statistics shows that in 2006, only three of IIT Kanpur�s 273 BTech students and two from the five-year MSc integrated course went abroad. All the others � 267 MTech students, two-year MSc grads and MBAs � stayed back in the country. At IIT Delhi, of the approximate 1,000 job-seekers, only one student went abroad to join CapitalOne, a financial consulting firm.

    The slowdown is evident even at the older IITs. At IIT Mumbai, 95% of the students were placed in India while at IIT Madras, only two BTech students went on to join Lehman Brothers at the Tokyo office.


    "There was a time when I had to set aside days to write recommendation letters for students wanting to go abroad, either to study or work," says Ashok Misra, IIT-B director. ��Now, because good jobs are available to BTech students, not many opt for post-graduate courses abroad. Only about 15% students go overseas for higher studies and approximately 5% take a job outside India."

    Ratnajit Bhattacharjee, faculty in-charge (training and placement) of IIT Guwahati, says corporate giants still opt for IITians but prefer to recruit them for their India operations. Bhattacharjee attributes the phenomenon of "almost zero brain drain" to the fact that MNCs have not just entered the country in a big way but are also looking at greater expansion here. "British Telecom used to regularly hire IIT Guwahati students,�� he says. ��It does today also, but for its Bangalore operations."

    Deepak Phatak, former head of the computer science department at IIT Bombay, who conducted exit interviews with students from 1991 to 1994, remembers almost everyone then was flying to the US.

    i think they will have to wait till the end of the quarter to assign that quota, how would they know about the number of the prospective applicant ahead of time? They first have to make sure that "current" status people should get a visa number. Not a fact i like, but thats the way it is...
    But at the same time EB2 will get spillover from EB1 and EB2 ROW, so its expected that EB2 I will move forward. But how much that spillover is gonna be? Any data?

    Had anybody have to send Driving License for filing extention of h1b?

    I am not understanding if sending DL is an issue or your concern is just over why USCIS is even asking for it?? USCIS does lot of things in unexpected way.. so I won't be surprised...

    Try your best to find a job. The market is picking up. At least try to join one of those desi companies even if they are offering a low salary. Just get past this time without making your situation a whole lot more complex.

    Dont worry about lawyers, your ex employer revoking I140 - all that stuff doesn't matter now - just go find a job.


    I am not sure if I should be happy or sad with this news. I was laidoff recently and had applied for I-485 on July 17,2007 i.e. current processing date for TSC. Also with this bulletin I will be current (EB2 2006). I have not found a new job yet and my company has told me that they will be revoking my I-140 after 30 days. My company lawyers are not advising me much citing conflict of interest.

    What options do I have? Will sending a new G-28 form at this time raise any issues that I do not have job with original employer as my PD is current and it is quite possible that my case maybe adjudicated. In the meantime if I do not sent new G-28 form I am not sure how much my company attorney will co-operate

    Hi,

    USCIS online status showed that my Approved AP was mailed on Jan 8, 2008. Looking that I bought ticket for travel on January 29, 2008 but untill today I or my attorney did not get the approval letter yet. I am under very mental pressure whether I will get it by Jan 29 or not. If I have to change my travel plan there will be huge cost involved as I have to change four tickets.

    Do any of gurus have any idea what should I do ? My attorney is not helping me. In my area (Washington) no infopass appointment available before Jan 29. Do you think walk in into the local office will help me even if I dont have any appintment ?

    Not to put any dampers here, but this is extremely frustrating for the EB3 India folks. I mean how freakin long do WE have to wait before we get our turn!

    I agree with eb3_nepa...waiting with EB3 PD March 2002..original labor certification...people who applied after me getting citizenships...it is frustrating.

    Common people. We desperately need atleast THIS campaign to be a success. I mean as a team the IV core CANNOT ask for an amount lesser than $5.00.

    We are a member base of 30,000 members, cant we all contribute this once? It is exactly FIVE dollars that we ask of ALL members.

    If we cannot get every single silent/dormant member to contribute atleast this once, then maybe we should just pack up our bags and fold, coz if we cant even contribute FIVE DOLLARS for our own betterment, we are in a very sorry state.
