I was following this thread and it has good information.
I have EB3 labor and I-140 approved with priority date March 2005. I couldn't file my I-485 in 2007.
Recently thru same employer I filed EB2 labor which got approved in Sept 2010. I have filed my I-140 under regular processing. I asked my attorney and he said as I already have one I-140 approved I should file this one under regular processing. USCIS might reject premium processing. Any advice.
My 6th year of H1-B is getting completed on Sept 2011.
Please suggest should I file my I-140 under premium processing? Should I try to convert it???

Officially 15 days. But according track itt website , it is taking at the most 8 or 9 days.

They could have done this and re-captured visas with additional fees or whatever. And called it greencard fraud fees it that makes them happy. But the fact is they did not want to do anything to give relief to Immigrants. Recapture (hundreds of thousands of visas) would have significantly helped helped retrogressed countries like EB3 India, China, ROW and EB2 India China. They can take additional fees as long as we know the recapture is being done.
Just looking at the employment based inventory statistics, if every applicant were charged $2000 for visa recapture, it is close to $400M for uncle sam. All EB backlogs would be eliminated, new immigrants would continue contributing to Social security, pay taxes, buy new homes, invest etc... Cant they see the potential upside to this?

As far as I know your country of origin doesn't matter under PERM. Correct me if I'm wrong.

I thought the Background check and AP are independent of each other. Perhaps one of the gurus can confirm this.
Now I am worried too... man the surprises never end!
Does anybody know whether USCIS do background checking on AP application or not ? It seems for my case they are doing as the IO told me.

The only way to get the stimulus payment is to obtain a Social Security Number for �non-work� purposes. The SSA may issue an SSN to an alien under the following provision:
20 C.F.R. � 422.104(a)(3)
(i) You need a social security number to satisfy a Federal statute or regulation that requires you to have a social security number in order to receive a Federally-funded benefit to which you have otherwise established entitlement and you reside either in or outside the U.S.;

I have got a PM from another IV member whose 485 got denied yesterday because of 140 revocation. He switched the job after 180 days and sent AC21 docs as well. He is willing to share his ordeal with us.
Are we sending personal exp of the ppl affected along with the letter ? I guess, it makes perfect sense to send some real 485 denial examples.
I mentioned in this thread about the response that I got from ombudsman. So they would love to hear about the specific cases. In fact they would be more than willing to look into the specific cases. because that gives the strength to question USCIS.

I do not get it either. They seem to have this very complex formula to determine where to move the cutoff dates or they simply roll a dice. Is there no transperancy. Sometimes I figure I should just not be bothered. It is black box!!. But I can really not do that!. Atleast we are participating actively in the call campaigns. But is that all we can do?

It is an Aug 08 fiasco instead of July 07 and this time they are being a lil reserved and not making the dates all the way current. Ofcourse there would be some lucky draws who get their GCs, we will have to wait and watch coz thatz all we (most of us) can do at this point.
Guess what, they are all celebrating my Birthday and that is why.

Hi all .. I am not writing this post to disagree with any one on any thing. I am very respectful of the members who participate this forum and write their suggestions/comments/ideas... Specially when I know people who are facing the same problem but do not make any efforts to solve it or join IV.
In the same lines .. my opinion , we probably need more followers and implementers who can direct IV core suggested plans.
Actively participating the Forum and visiting the web site regulary is one of the actions called for from Pappu (IV Core), you are all doing, I did that. There are other action items that need be implemented by who ever has ability, time and can direct others.
BOTTOM LINE, YOU FOLKS BRING UP INTERESTING IDEAS AND DEBATE TO THE FORUM .. PLEASE KEEP IT UP.
