I filed my 485 in August 2008 with new fee structure (one time fee for AP and EAD renewals). Now my AP is expiring in November 2009. Can any one who applied for AP renewal under the one time fee structure let me know how do I make use of that fee. I mean.. Can i just skip sending the check for $305?

My I-140 & I-485 applications had been transferred to VSC for receipting and later my I-485 was transferred back to TSC. But my I-40 has been pending at VSC for close to 6 months with no signs of any processing. VSC seems to be still processing Apr 06 applications while TSC has been processing I-140 under 6 months. Realistically my application should have stayed at TSC, but was transferred to VSC due to receipting delays and balance the workload. But now my application is stuck at VSC. For no fault of mine, my applications ended up in VSC. There is no signs of PP starting anytime soon. Can I lodge a complain to ombudsman in this regard? Will they be able to help me? Who do I contact and where can I find all the information to lodge a complaint?

yes. you cannot file AoS while out of country. you can file for yourself, but will have to file for the dependent/s when they return.

Hi, my friend have not receive her fingerprint, her husband filed for I-485 on june 2007. their PD is 2004-ROW. their case forwarded into TSC. do you think this is normal ? what is the possible solution for this issue ?

I am applying to renew my EAD and looking at the paper Application on page 7 I see that if you are C9 which all of us are mostly..we need not file an application fee..
Is it true..
Plz help

If you paid the new fees when you filed last year then you don't have to pay the fees again this time. But if you paid $180 for ead then pay again now.

I am planning to visit India for a10 days in October. I have a valid h1b status till 2010 which I thinking of getting stamped at new delhi. But it seems the PIMS verification delay is making people wait for weeks and months. I have an AP which I can use to enter as an alternative. But I wanted to know if anyone had experience in stamping at the delhi consulate? Do they keep the passport if it is send for PIMS verification? In that case I'll drop the idea of getting it stamped and use my AP (though I want to avoid doing that snce I want to maintain my h1b status).

My fiancee is currently on H1B (got through the 2008 quota) and I am currently on F1 visa status. She is planning to go on an F2 as my dependent.

Please clarify these doubts:
When she gets a job while she is on F2 and the new employer processes her H1B does she have to go through the whole process of H1B as a new visa issue (annual cap) or is it like an H1B transfer?

Once going from H1B to F2, is there a certain time period one has to wait before one can go back to H1B?

If the F2 application is pending, is it possible to reapply from F2 back to H1B?

Any help will be greatly appreciated.

Hi,

I am planning to go to India for 3 months. I have EAD and AP, H1B visa stamping valid till 08/30/2010. Now I am on EAD.

From past 3 months, I don’t have project, so I am thinking to go India and come back in the month of Jan 2010 (if US market improves).

My wife is working on EAD and she will be staying in US.

What are the problems I may face at POE, US? (Possible Chicago POE)

Please let me know, what r all docs required and what r all questions will be asked, if I enter on AP or on valid H1B visa stamp.

It will show in the pay stub as commission. Is it legal to get commission under H1B (please remember I am a programmer analyst) ?

I work full time and will continue to work with same employer in the near future, despite having switched to EAD. However, I will use AC21 if a substantially better opportunity presented itself.:)

You can do it yourself. Its easy with e-filing and so many (including yours truly) in this forum have done it. Check out this thread for more info:
