Hi,
I am EB3 candidate, with estimate to get GC in 2032. Since Visa recapture bill is not on table. And is part of Immigration Reform Bill (part of reform for illegal people); considering fact that Health Care opposition, election year, 10% unemployment & other unknown factors; I do not see any hope of changing law for employment base (no hope for visa recapture).
Do seniors or admin team see any hope for EB3 candidate?

Companies can change their address after filing your 485 and there is no reason to intimate USCIS if the company's address change. BUT make sure your address is correct on their system. THIS IS VERY IMPORTANT

Valid EAD along with SSN is used for work. As you are waiting for the corrected EAD, you cannot work I guess.

1500 H-1Bs were claimed in the last week and just over 20,000 remain for the fiscal year. Based on a four week rolling average (1175), I am projecting the target will be exhausted in 17 weeks which will be February 23, 2011. Previously, I had been projecting March, but the overall usage of H-1Bs has been somewhat busier in the last month than in previous months. Correct me I am wrong here:
AP allows you to enter US without a valid visa.
EAD allows you to work in US for any employer.
Untill and unless someone utlizes his EAD, he is still on H1 (if he has valid H1) doesn't matter he enters US using AP. Am I correct?
Then question arrises, If H1 holder changes his job then he needs to transfer his H1 only and not use EAD. Is this possible to have H1 renewed and transfered even though one has EAD approved, meaning is it compulsory to use EAD one you get it?

My case was filed on july 2 and got rejected due to incorrect fees. I was told, it was mail room error and was refiled on Sep 12th. I was under the impression that all the rejected cases have receipts numbers and the cases are entered in USCIS database.
I called USCIS and my case information is not in database yet. My attorney told me that they only have a reference number for inquiry(yet to explain why no receipt number instead).
Have you guys seen this happening in other cases?

Hello. I am playing around with making a little app that allows me to draw a polygon shape and then determine how many rectangles can fit inside that shape. The rectangles only have two widths, but can be as long as needed.
It occurred to me that I might somehow be able to have that polygon shape act like a wrap panel and the rectangles inside would self-adjust based on the space provided. Two questions:
1) Is it possible to make a wrap panel with custom borders (not just rectangular)?
2) Is there an equivalent component, to the wrap panel, in Flash? If so, can that component have custom borders?

BTW Is this a big deal in approving 485???
Anyways, can someone pls direct me(if there is thread covering 2004 approvals) or share your thoughts around PD 2004 approvals?

I have a PD of September 2007 in the EB-2 category. I am currently on an H1B 3 year extension(after 6 years) on basis of an approved I-140.I am a physician and would like to pursue a fellowship given that it is unclear how many years I will have to wait to get a green card. Can I extend the H1B (change employer),given that I got the 3 year extension of the H1b on the basis of an approved I-140? What are the consequences for the H1B visa (employer change).I know I may have to start my green card process all over again.Thank you.

My 485 is under processesing with a priority date of March 2006.
I was browsing through the instructions to e-file my I-131 (Travel document) and found this interesting point and was a little confused.
This is from USCIS website
You are not eligible to electronically file this form if:
You have a pending I-485, Application to Register Permanent Residence Status or Adjust Status currently at a USCIS office and you are eligible to file the I-131 for no additional fee.
Does this mean we can no longer file for I-131 online...? I did this last year and didnot have any issue's. Any thoughts/opinions/experiences are highly appreciated. Thanks

One of the comments on my post earlier today about the killed Border Patrol agent seemed pretty harsh - accusing most BP agents of being restrictionists with bad motives. I have applied I-485 in July 2007. My Priority date is May22, 2006 (which is current as per August VISA Bulletin). But I haven't received the Finger Printing notice yet !!
I also went to Local Office but they also couldn't help me.
What I am suppose to do in that case?
