Dear Attorney,

Below are my details:

Current work status : H1B
Applied for I-485 , July'07 filer, priority date: jun EB3 category

My husband details:

Current work status : H1B
Applied for I-485 , July'07 filer, priority date: Feb EB3 category

We both have separate EADs and H1B visas and are independent of each other currently.

Because my priority date is 2006 and my husband's is in 2005, there is more possibility that he may get GC before my PD becomes current.
When my husband's priority date becomes current, he wants to file it for me again so i would get GC along with him.

I am now considering to look out for jobs and use my EAD card with new employer.

Can I make my EAD active ? Will it cause any problems when my husband's priority date becomes current and when we file my application along with his ?

Any input is greatly appreciated.

Forgot to mention that my I-140 was also approved in Jan 2007. This was not a concurrent filing. I filed I-485 after getting I-140 approved.

My I-140 & I-485 applications had been transferred to VSC for receipting and later my I-485 was transferred back to TSC. But my I-40 has been pending at VSC for close to 6 months with no signs of any processing. VSC seems to be still processing Apr 06 applications while TSC has been processing I-140 under 6 months. Realistically my application should have stayed at TSC, but was transferred to VSC due to receipting delays and balance the workload. But now my application is stuck at VSC. For no fault of mine, my applications ended up in VSC. There is no signs of PP starting anytime soon. Can I lodge a complain to ombudsman in this regard? Will they be able to help me? Who do I contact and where can I find all the information to lodge a complaint?

I came to US on L1(worked for 1 year) and then switched to F1 till getting my H1B on May 2005 (which is 2 years old). How many years(3 or 4) do I have left on H1? I mean will the 1 year L1 count towards the total six years allocated for H1B?

AFAIK L1 counts towards that 6. So if you have done 1 on L1, 2 on H1, then you have 3 more years left on H1

Hi all,

I need some good advice and facts...

My friend's H1-B extension is approved but the stamping (Mumbai consulate) might get denied due to a previous (dismissed) charge for driving with suspended license.

What are the options after that? Can he re-apply for the visa stamping again using the same H1-B approval petition? Can we appeal the decision since it document clearly states that the fine was paid?

Please advise.

Hi All,

My wife is on her first year of OPT, she is masters in STEM so she is eligible for 17 month extension.

In-order to re-new her OPT she needs get herself e-verified. However, her employer said thay they are not registered for e-verify system.
My question is �
- Is it possible to renew OPT without e-verification, if yes how?
- What are options in that case if her employer does not e-verify?

Hi,

I am currently a dependent E-1 on my wife's visa and currently have a valid EAD which will expire mid-2010.

We are about to file I-140 and I-485 and my question is, should I also file for a new EAD at the same time even if its still 8 months from expiry? I'm not sure what the difference is between an EAD under the E-1 visa, or an EAD when filing the I-485, or if it doesn't matter at all.

Dear Attorney,

i would like to join a very good opportunity on EAD but have one concern shown below.

"a person has a valid ead/ap and he is gone outside the country for some work purpose and uscis denies his 485 in an illegal way like for eg: (denying AOS applications that have been pending more than 180 days when an employer revokes an I-140). how will he enter USA then ??
can he file MTR when he is outside the US with the help of a lawyer ?"
